1. By the present writ petition, the petitioner is seeking a limited relief that is, for early disposal of appeal under Section 44 (2) of CGLRC SHOAIB ANWAR Digitally signed by SHOAIB ANWAR Date: 2025.02.05 23:10:36 +0530
2 which is pending before the Additional Commissioner Bilaspur division respondent No. 2 bearing appeal no. 76-A-6/2018-19
“Kailash Dubey vs. Johri & Others”.
2. Learned counsel for the petitioner would submit that the appeal under Section 44 (2) is filed by the respondent against the order of the SDO Bilha, Bilaspur dated 09.02.2018, which is pending since 31.03.2018, but the same has not been decided by the Commissioner till date. Learned counsel for the petitioner further submit that Additional Commissioner be directed to decide the pending appeal within a stipulated period.
3. Learned counsel for the State would submit that as the appeal has been filed in the year 2018, the same shall be considered and final
order will be passed within a stipulated period.
4. I have heard both the parties and perused the appeal memo (Annexure P/5).
5. As the appeal has been filed in the year 2018 the writ petition is
disposed off with a direction to the Additional Commissioner/Respondent no. 2 to decide the appeal of the petitioner, within a period of 50 days from today.
6. With the aforesaid direction, the writ petition is disposed of. Sd/-
