1. Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 34 of the Indian Penal Code. 3. Learned counsel for the petitioner submits that the petitioner has antecedents of four cases and the informant alleges that in the year 1998, she along with Champa Devi and Manju Devi purchased 2 katha 13 dhur 6 dhurki of land at Danapur from Sarvesh Kumar. Thereafter, the land was mutated and they were paying municipal rent. Further, they came to know that Sarvesh, from the same land, sold 4 decimals of land to Ranjit, land mafia vide registered sale deed dated 19.09.2023

Further, Abhimanyu is an identifier on the sale deed and Shailendra Sah is the witness. 4. Learned counsel appearing on behalf of the petitioner submits that from the perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that Sarvesh sold 4 decimals of land from the same plot which the informant and others had purchased in the year 1998 to one Ranjit in which the petitioner along with others were involved. It is next submitted that the petitioner is not a purchaser of the land rather he has been made an accused in the case based on the fact that it was on his instance that Sarvesh sold the land to Ranjit. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that the petitioner has antecedents of four cases and the cases appear to be of cheating.
It is next submitted that of late in the State of Bihar, the price of land has skyrocketed and such land mafias are indulging in grabbing the land. It is also submitted that even if the privilege of anticipatory bail is granted to the petitioner, in that event the petitioner may abscond, on which learned counsel appearing on behalf of the petitioner submits that the petitioner

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Phulwarisharif P.S. Case No. 450 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. Further, one of the bailors of the petitioner shall be his brother, namely, Amit Ranjan. 8. It is made clear that in the event if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner despite giving assurance to this court is not co-operating in the investigation in that event the learned trial court shall be at liberty to cancel the bail bonds of the petitioner. 9.
