This writ petition has been filed with the following prayer: "I. To, issue a writ, order or direction in the nature mandamus commanding and directing to respondent no.2 to decide the Case No. 634/2022 having computerized Case No. C202215000000634 (Shankar Vs.Chief Revenue Officer, Azamgarh), under section 38(4) of U.P. Revenue Code-2006 as expeditiously as possible preferably by way of day to day hearing within stipulated period." It is contended that Case No.634 of 2022 (Computerized No.C202215000000634), under section- 38 (4) U.P. Revenue Code 2006 is pending consideration before respondent no.2. The sole prayer made in the writ petition is to expedite the aforesaid case. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2-Additional Commissioner (Judicial), Azamgarh Division, Azamgarh to decide Case No.634 of 2022 (Computerized No.C202215000000634), under section- 38 (4) U.P. Revenue Code 2006, in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
