Mr. Ashish Kumar Singh, learned advocate appears on behalf of petitioner and submits, his client's application for renewal of license to run pathology clinic was rejected giving reasons uploaded in the portal on 19th May, 2025. His client has challenged the rejection. 2. He submits, prior to application for renewal and during subsistence of the license, petitioner's brother made complaint to the authority. Without giving opportunity of hearing petitioner's license was suspended. His client approached by Writ-C no.690 of 2025, wherein by interim order dated 10th January, 2025 the suspension was interfered with. He submits further, first defect of not uploading the information was removed prior to the rejection on 19th May, 2025. Pendency of said writ petition cannot be a ground to not renew the license. He seeks interference. 3. Dr. D.K. Tiwari, learned advocate, Additional Chief Standing Counsel appears on behalf of State and on query submits, the rejection information was uploaded on 19th May, 2025. 4. We have obtained confirmation that rectification by uploading the information on 16th May, 2025. We accept contention of petitioner that pendency of the writ petition cannot be a ground to not renew the license since the authority's position is to proceed to cancel the license on having had suspended it. That is subject matter of the pending writ petition. The authority cannot remove subject matter of that writ petition by not renewing the license. 5. Impugned rejection is set aside and quashed. The authority will pass fresh order on the renewal of application within two weeks from communication of website copy of this order on petitioner's undertaking to apply for certified copy.
