Sireesha Rani Vallabhaneni, Standing Counsel For Municipalities The Court made the following: 2 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO CONTEMPT CASE NO.823 of 2023 ORDER: The writ petitioner i.e., Pydi Syamala Rao, S/o.late Narayana Murthy, who filed W.P.No.12043 of 2021 seeking a direction to the respondents not to demolish the house in Dr.No.5-1-84/1 to an extent of Ac.0.02 cents situated in survey No.42 and 16-28 of Krishnapuram, Amadalavalasa, Srikakulam District as the official respondent No.2/Commissioner, Amadalavalasa Municipality issued notice to the writ petitioner on the representations/complaints made by the contempt petitioner/unofficial respondent No.4 by name Kota Sithamma. 2. The present petitioner in the contempt case was unofficial party respondent No.4 in the aforesaid writ petition. After hearing the unofficial party respondent and the writ petitioner, this Court delivered the following order, dated 29.03.2022 directing the writ petitioner to offer explanation for the notice, dated 20.05.2021 treating the show cause notice and on receiving such explanation, the 2nd respondent was directed to pass appropriate orders as per the rules by stipulating some time. Till passing such orders, the respondents were directed not to take any coercive steps against the subject property like evicting and demolishing. 3. Despite the direction given by this Court, the respondent authorities have not taken any action against the subject property and, 3 hence, the present contempt case is filed under Section 10 to 12 of the Contempt of Courts Act. 4. As there is no representation on 05.02.2025, this Court directed to issue Form-I notice to the sole respondent. Now the contemnor has filed counter affidavit stating that as directed by this Court, after receiving the explanation from the writ petitioner, the respondent passed order vide Roc.No.83/2022/G1, dated 30.06.2022, in accordance with law. 5. As the respondent has been complied with the orders of this Court, nothing survives for further adjudication. Hence, the Contempt Case is closed. There shall be no order as to costs.
