It was further submitted that the written statement was filed in the year 2005 and, thereafter, the hearing of the instant suit did not proceed for absence of the plaintiff. It seems that notice had been served upon the learned advocate representing the plaintiffs by the learned advocate representing the defendant. However, none appeared to represent the same.
