On default being committed, proceedings have been initiated against the petitioners under the provisions of the SARFAESI Act and an Advocate Commissioner appointed under Section 14 of the SARFAESI Act by the Chief Judicial Magistrate Court, Pathanamthitta has issued a notice for taking physical possession of the secured asset. 2. Learned counsel appearing for the petitioners would submit that the petitioners have submitted Exhibit P7 request before the respondent bank essentially praying that only the extent of property that may be required for satisfying the liability be taken possession of, after excluding the residential house of the petitioners. 3. Learned counsel appearing for the respondent bank submits that a decision can be taken on Exhibit P7, though it is not clear as to whether the claim of the petitioners that proceedings against a portion of the property alone will be sufficient to clear the liability, is actually feasible. 4. Having heard the learned counsel appearing for the petitioners and the learned counsel appearing for the 2025:KER:30460 WP(C) NO. 12656 OF 2025 4 respondent bank, the writ petition will stand disposed of, directing that the competent Authority of the respondent bank shall take a decision on Exhibit P7 (if it is received and pending) within a period of two weeks from the date of receipt of a certified copy of this judgment. Till such time as a decision is taken on Exhibit P7, steps for taking physical possession of the secured asset shall stand adjourned. I make it clear that I have not expressed any opinion on the merits of the matter and it will be open to competent Authority of the respondent bank to take a decision on Exhibit P7, in accordance with the law.
