Respondent(s) Through: Mr. Furqaan Yaqoob, GA Coram: Hon’ble Mr. Justice Rahul Bharti, Judge. ORDER 03.03.2025 Without having taking trouble to approach the Deputy Commissioner, Baramulla or for that matter the Director Geology and Mining Kashmir, for bringing their attention to the petitioners’ purported grievances i.e, excavation/lifting of soil pursuant to order No DMO/DGM/BLA/2024-25/3403-13 dated 06.12.2024 has been overstretched by licensee i.e, respondent No. 6 and 7 before guiding themselves to come to this High Court, the writ petition lacks bonafidees which fact is evident from the fact that while the activities of excavation was to last from 7th December, 2024 to 13th December 2024, the petitioners are stated to have filed representation dated 29.11.2024 to the Deputy Commissioner, Baramulla rather than coming up with a representation post 13th December 2024 to allege that the digging and removing of soil has taken place without any authorization. The petition lacks merit on the facts pleaded and is, accordingly, dismissed. (Rahul Bharti) Judge SRINAGAR 03.03.2025 Aasif
