1. A perusal of the Orders dated 04.11.2025, 10.02.2026 and 02.04.2026 reveals that the Petitioner had undertaken to vacate the subject premises. It was recorded in the Orders dated 10.02.2026 and 02.04.2026 that the Petitioner would vacate the subject premises on or before 30.04.2026. The Petitioner was also directed, vide Order dated 10.02.2026, to place on record an Affidavit of Undertaking to the aforesaid effect. 2. The relevant portion of the Order dated 10.02.2026, which was reiterated in the subsequent Order dated 02.04.2026, reads as under:
“2. In pursuance of the order dated 04.11.2025, learned counsel for the petitioner submits that the latter will vacate the subject premises by 30.04.2026. He shall also clear all the statutory dues including water and electricity bills. Let an affidavit of undertaking be placed on record by the learned counsel for the petitioner before the next date of hearing.” This is a digitally signed order. 3. None had appeared on behalf of the Petitioner on 02.04.2026. Even today, there is no appearance on behalf of the Petitioner. Further, despite the specific direction contained in the Order dated 10.02.2026, no Affidavit of Undertaking has been placed on record. 4. It is also pertinent to note that the time granted to the Petitioner for vacating the subject premises has since expired. Despite the expiry of the stipulated period, neither has the Petitioner appeared before this Court nor has any information been placed on record regarding compliance with the undertaking in the aforesaid Orders to vacate the subject premises. No request seeking extension of time or any other direction has also been made on behalf of the Petitioner. 5. In the aforesaid circumstances, particularly in view of the continued non-appearance on behalf of the Petitioner, the failure to place on record the Affidavit of Undertaking as directed by this Court, and the absence of any information regarding compliance with the undertaking to vacate the subject premises despite the expiry of the stipulated period, this Court is of the view that no further orders are required to be passed in the present Petition. 6.
In view thereof, the present Petition stands dismissed. 7. It is, however, clarified that the Respondent shall be at liberty to pursue the execution proceedings already instituted before the learned Executing Court, in accordance with law. 8. The present Petition, along with pending Application(s), stands
disposed of in the above terms.
