CRL OP No. 16813 of 2025 & 120 B of IPC in connection with Crime No.87 of 2024, seeks bail. 2. The case of the prosecution is that the petitioner (A2) and A1 hatched a conspiracy to grab the property of Tr.Pradeepan, who resides in Germany. The property was located in Chennai, was purchased by Tr.Pradeepan in the year 2008 and registered in his name. A1, who was a tenant in the property, created a forged adjudication doc. No.1373/2019 dated 07.02.2019 at SRO, Triplicane, using a fake life certificate of Tr.Pradeepan. Based on this forged document, A1 executed a sale deed in favour of A2 vide document No.1564/2021 dated 08/02/2021 at Joint-1, SRO, Saidapet. The petitioner then mortgaged the property to U-Gro capitals for Rs.30,60,000/- and obtained additional loan of Rs.16,00,000/-. However, Tr.Pradeepan was unaware of these transactions and only discovered the fraud when he verified the encumbrance certificate. 3. The learned counsel for the petitioner submits that he is innocent and has not committed any such offence as alleged by the prosecution. He further submits that he has been falsely implicated in this case. The learned counsel for the petitioner further submits that the coaccused were already released on bail and this petitioner has been unfairly targeted and the petitioner is in custody for a considerable period and he is ready to abide by any stringent conditions that may be imposed by this Court and hence, prays to grant bail to the petitioner. 4.
The learned counsel for the intervener raised strong objection stating that the defacto complainant was settled in Germany and that he wants to sell his property, he sent all the original documents pertaining to the subject property to one of his friend Ruthran, who is A1. Thereafter, A1 created forged and fabricated documents and executed a sale deed in favour of his petitioner herein and also falsely created Life Certificate and obtained loan to the tune of Rs.60 lakhs, by mortgaging the said property. 5. CRL OP No. 16813 of 2025 would submit that after the case was registered, A1 and A2 approached this Court vide Crl.O.P.No.12957 of 224 and were granted anticipatory bail by order dated 24.06.2024, with a condition to deposit a sum of Rs.30,00,000/- within three weeks. However, despite several months passing, A1 and A2 failed to comply with the condition. Consequently, the respondent police moved a cancellation bail petition, and this Court, by order dated 28.11.2024, cancelled the anticipatory bail due to non- compliance of the order dated 24.06.2024. Following the cancellation, the petitioner was arrested and the learned Government Advocate (Crl.Side) raised objection stating that there is a possibility of abscondance, tampering of evidence and hindering further investigation. Hence, prays to dismiss the bail petition. 6. Considering the conduct of the petitioner, the gravity of office and the stage of investigation and the overtact of levelled against the petitioner, this Court is not inclined to grant the relief sought for by the petitioner. https://www.mhc.tn.gov.in/judis
