Considering the submissions advanced by learned counsel for parties and upon perusal of record, prima facie, it appears that the informant and the applicant have entered into an agreement for the purposes of purchase of two flats for which the entire consideration has already been paid by the informant, yet the aforesaid flats have not been allotted. Learned counsel for applicant upon instructions has undertaken that in lieu of aforesaid consideration, either the two flats would be allotted to the informant or the amount would be refunded. It is evident that the informant had a remedy for filing of application before the RERA which he has not done. Prima fiacie, a civil dispute appears to be given a criminal colour. Previous criminal history of applicant has been explained in the affidavit filed along with the application.
