Heard the parties.
The petitioners have been made accused in connection with Herhanj P.S. Case No.43 of 2024, for the offences registered under Sections 17(b), 18(c) and 22(b) of the N.D.P.S. Act, pending in the Court of learned Sessions Judge, Latehar.
It was submitted that 657 grams of opium was recovered from the joint possession of these petitioners. It was further submitted that quantum of seized opium comes within the purview of intermediary quantity. It was finally submitted that the petitioner No.2 has got no criminal antecedent whereas one criminal case relating to land dispute is pending against petitioner No.1.
Learned Spl.P.P. has opposed the prayer for bail.
In view of the submission made above, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, Latehar, in connection with Herhanj P.S. Case No.43 of 2024.
