The applicant is in jail since 27.07.2023. The bail application of the applicant was rejected by the learned trial court on 18.09.2023. The following arguments made by Shri Devendra Kumar Tiwari, learned counsel on behalf of the applicant, which could not be satisfactorily refuted by Shri Suchit Tandon, learned AGA from the record, entitle the applicant for grant of bail: 1. The applicant has been enlarged on bail by order dated 30.04.2025 in the same offence under Sections 376, 506 IPC and 67 of IT Act by this Court in Criminal Misc. Bail Application No. 43716 of 2024 (Shyamu Patel Alias Rajesh Kumar v. State of U.P.). 2. This is the bail application in the added sections i.e. Sections 376D of the IPC. 3. For the reasons stated in the bail granted to the applicant by order dated 30.04.2025, the applicant is entitled to be enlarged on bail under the added section as well. Let the applicant-Shyamu Patel Alias Rajesh Kumar be released on bail in Case Crime No. 400 of 2023 at Police Station Soraon, District Prayagraj under Section 376D IPC under the same conditions.
