1. By the present writ petition, the petitioner is seeking a direction towards the respondent authorities/ Central Board of Secondary Education (CBSE) to decide her application dated 03/01/2024 (Annexure P/3) for correction of date of birth in the marksheet of Class 10th, Secondary School Examination, 2022 wherein the date of birth of the petitioner has wrongly been mentioned as 11/02/2007 in place of 11/01/2007.

Learned counsel appearing for the petitioner submits that due to some bona fide mistake, the date of birth of the petitioner has been mentioned in the marksheet of Class 10th, Secondary School Examination, 2022 as 11/02/2007 and after knowing about the said discrepancy, she submitted an application dated 03/01/2024 for correction of her date of birth however, the respondent Board has rejected the said application vide letter dated 18/11/2024 (Annexure P/4) by requesting the petitioner to submit a new application to the Board Office, alongwith attested copies of all required documents, duly certified by the school Principal.

Learned counsel appearing for the respondent/ Board, on instruction, submits that though the application for correction has been rejected vide letter dated 18/11/2024 with a request to the petitioner to submit a new application to the Board Office, alongwith attested copies of all required documents, duly certified by the school Principal, ensuring that all documents are uniform
3 / 3 and consistent, hence on submission of new application through proper channel, the same will be considered within the stipulated period.
4. I have heard learned counsel for the parties and perused the documents.
5. From perusal of the letter dated 18/11/2024 (Annexure P/4), it appears that the Board has requested the petitioner to submit a fresh application to the Board Office, alongwith attested copies of all required documents, duly certified by the school Principal.
6. In view of the above, the petitioner is directed to submit a fresh application through the respondent No.5/School with all the requisite documents duly certified by the concerned school Principal. In the event of submission of such application, the respondent Board is directed to consider the same and necessary correction in the marksheet of the petitioner for Class 10th, Secondary School Examination, 2022 be made within a period of 30 days from the date of submission of such application, in accordance with law.
