1. The petitioner is seeking the concession of anticipatory bail under Section 482 read with Section 528 of BNSS, 2023, in case FIR No.63 dated 06.05.2025 under Sections 109, 115(2), 126, 3(5), 351(3) of BNS, 2023 and Section 25 of the Arms Act, 1959, registered at Police Station Samana, District Patiala.

It has been vehemently argued by the learned counsel for the petitioner that there was no history of any strained relations between the complainant as well as the petitioner and hence, there could have been no occasion for him to have participated in any manner in the occurrence in question. It has also been argued that it is an entirely trumped up and fabricated case which has been planted by the complainant upon the accused, including the petitioner, on account of a history of strained relations between the complainant and the co- accused.

4. On asking of the Court, Mr. H.S. Deol, Sr. DAG, Punjab, accepts notice on behalf of the respondent-State. 5. Learned State counsel has vehemently opposed the prayer and submissions made by the counsel opposite by drawing the attention of this Court to the allegations levelled in the FIR which stands reproduced hereinunder:-
“At this time, it is recorded that a statement of Sukhman Singh son of Pritpal Singh resident of village Tambuwala, Police station Sadar Patran, aged about 18 years mob. No. 86993-93421, written ASI Narata Ram 2426/Pat. Masura Police Post, Mavi Kalan for registering case against Gurloveleen Singh alias Geen resident of village Kakrala Bhaika, Akash Sohi resident of Prem Singh Wala and Mastan Singh resident of Kakrala Bhaika, Police Station Sadar Samana District, Patiala, under Sections 109,115(2), 126, 3(5),351(3) BNS 25/54/59 Arms Act, through PHG Balveer Singh, 18210, received at Police Station. Contents of which are as follows: it is stated that I am resident of aforesaid address and perusing PTE course at Patran, yesterday on 05-05-2025, he at village Kakrala Bhai Ka along with his friends Dilpreet Singh Chahal, Vanveet Singh, Dapinder Singh & Karanveer Sharma alias Mirch residents of Village Kakrala Bhai Ka were enjoying party at the house of Dilpreet Singh, it would be around 7.30 PM when they were returning to their house and he was driving paltina motorcycle of Parbjot Singh and Karanveer Singh alias Mirch was sitting behind him as pillion rider, when they reached near Gurudwara Sahib of Kakrala Bhai Ka, then one white Bolero came from behind on which word Patwar was written in Punjabi came close to us and was about to stop. We turned the motorcycle to the other side to save themselves. Gurloveleen Singh alias Geen, who was driving the vehicle, who lowered down the window and gave fire shot on him which hit on his left arm and he along with motorcycle fell down. Meanwhile Akash Sohi resident of Prem Singh Wala alighted from the conductor seat of Bolero and came towards him while carrying pistol and gave fire Shot with intention to kill which hit on his right foot. Meanwhile Mastan Singh also came out of the Bolero and raised lalkara that Sukhman and Karanveer Mirch should not be spared and kill them.
Then, he and Karanveer Sharma left the motorcycle there and ran into the village streets and thereafter all three- person fled away from the spot by giving threats along VINAY 2025.07.03 15:38 I attest to the accuracy and authenticity of this

Then, my friend Pargat Singh & Jasnoor Singh got him admitted to Harbhagwan Health Care Hospital, Patran in an injured condition, where I am undergoing treatment. The reason behind it is that there is some dispute going on between my friend Karanveer Sharma alias Mirch and Gurloveleen Singh, and to which they surrounded us and opened fire on us with the intention to kill us. Action should be taken against these people. I have got written my statement to you and read & heard same is correct Sd/-Sukhman Singh the above statement is correct/-Narata Ram ASI Chowki Mavi Kalan Police Station Sadar Samana Date 06-05-2025.”

It has been contended by the learned State counsel that a perusal of the allegations levelled in the FIR leave no manner of doubt that it was a pre-planned attack carried out by all the accused, who were armed with deadly weapons, including firearms; after intercepting the injured and the complainant, all the accused, fired indiscriminately towards them and it was only providence that saved the injured, who somehow managed to flee away from the place of occurrence after leaving their motorcycle behind. It has also been brought to the notice of this Court by the learned State counsel that the petitioner is a man of previous criminal antecedents as he was on bail when he yet again participated in the crime in question; it has also been submitted that five FIRs already stand registered against the petitioner involving identical offences.
7. I have heard learned counsel for the parties and perused the relevant material on record.
8. Prima facie there are serious and direct allegations against the petitioner, who is alleged to have fired shots towards the complainant. On account of indiscriminate firing, the complainant VINAY 2025.07.03 15:38 I attest to the accuracy and authenticity of this

CRM-M-29754-2025 received multiple firearm injuries on his person. In the circumstances and also keeping in view the criminal antecedents of the petitioner, he does not deserve the extraordinary concession of anticipatory bail. The instant petition stands dismissed accordingly.
