The appellant assails the correctness of order passed by the Family Court assessing maintenance payment to the wife at the rate of Rs.25,000/- per month keeping in view his gross salary at the rate of Rs.1,31,508/- per month. On account of failure of the appellant to file written statement, his defence was struck off and thereafter, the Court proceeded to finally decide the matter after allowing the respondent to lead evidence. 2. Learned counsel for the appellant submits that the impugned order is illegal and erroneous because the affidavits of assets and liabilities as directed by the Supreme Court were not submitted by the parties. 3. This Court has considered the submissions of learned counsel for the appellant. 4. The appellant does not dispute that his gross salary is Rs.1,31,508/- per month and his net salary is Rs.81,978/- per month. The MOHD AYUBrespondent has only been awarded Rs.25,000/-.
