Consensus has been arrived at between Mr. Jahangir Ganai, learned Senior Counsel for the petitioner and Mr. Sami Sabir Lone, learned counsel appearing for the private respondent that as the contesting parties are litigating before the Civil Court in respect of their respective rights qua the land which is the subject matter of mutation No. 1316 dated 17th of March, 2015 and that any decision by the Civil Court is binding upon the contesting parties, therefore, the present petition be disposed of with the direction that the rights of the contesting parties shall remain subject to the outcome of the civil litigation pending between the contesting parties. Ordered accordingly. 2. Needless to say, the Civil Court shall independently determine the rights of the contesting parties without being influenced in respect of any observation made in any order. 3. Disposed of.
