This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Case No. 8656 of 2023 in case crime no. 85 of 2023 under Sections 498A, 342, 406 I.P.C., & under Section 3/4 D.P. Act, Police Station- Kotwali, District- Bareilly pending in the Court of learned Chief Judicial Magistrate, Bareilly expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant is the wife in the matter and present case is pending since 2023. It is further submitted that the matter is pending at the stage of framing of charge and till now no charge has been framed. It is also submitted that the Court concerned is not taking any interest for disposal of the case. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. 6. From perusal of the record it is evident that the submissions made by the learned counsel for the applicant are wrong as the charges have already been framed by the learned trial Court on 29.3.2025 and since then the matter is pending at the stage of evidence. Since the applicant before this Court is the informant, it is her duty to present before the Court for recording her evidence but instead of appearing before the trial Court unnecessarily she has knocked at the door of this Court. 7. In view of the above, no direction is needed to be given to the trial Court for expeditious disposal of this case. 8. The application is, accordingly, disposed of.
