(Oral) Applicant is in judicial custody in FIR No.96 of 2024, under Sections 29, 60, 8 and 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Patel Nagar, District Dehradun. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. This is the second bail application. The first bail application, being BA1 No.491 of 2024, was rejected on 16.07.2024. 4. Learned counsel for the applicant submits that the entire case is false; the fact, which was never brought to the notice of the Court is that the specimen seal, which was prepared at the spot bears the FIR number, which was lodged much after delay. 5. Learned State Counsel admits this fact. 6. The Court wanted to know as to how is it? She submits that the PW1, in his cross examination, has admitted this fact, but he has not given any explanation to it. 2 7. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
