It appears from the record that petitioner has time and again sought time under the guise of seeking instructions as to the ownership of the muddamal in question. Today, also the position remains the same and no such progress seems to have been made. 2. Having heard the learned advocates appearing for the respective parties and examining the impugned order, it appears that questioned muddamal is not the simplicitor muddamal as submitted by learned APP as the same would go to the root of the case so as to establishes the factum as to the chatting inter se between the parties involved in the offence in question and the said muddamal has been sent to the FSL for scientific examination. Thus, without going into the merits of the matter any further, at this stage, the present application is disposed of reserving the liberty in favour of the petitioner to make an appropriate application R/CR.RA/1284/2023 ORDER DATED: 23/09/2025 at the time of conclusion of the trial under Section 452 of the Code of Criminal Procedure seeking custody of the muddamal which will be decided in accordance with the law by the learned Court below.
