2025:JHHC:10478 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 1744 of 2025 ------ Hari Prasad Mahto @ Hari Prasad son of Mahabir Mahto resident of Village Benganria Nagri Kala, P.O. and P.S. Tundi, District Dhanbad, Jharkhand .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opp. Party CORAM: HON'BLE MR. JUSTICE GAUTAM KUMAR CHOUDHARY For the Petitioner : Mr. Sheo Kumar Singh, Advocate For the State : Mr. Bhola Nath Ojha, A.P.P. ------ Order No.05 Dated : 28.03.2025 Heard both the sides. The petitioner- Hari Prasad Mahto @ Hari Prasa in custody since 13.02.2023 in connection with Hatia Rail P.S. Case No. 03 of 2023 for the offence registered under Sections 20(b)(ii)(c)/29 of the NDPS Act pending in the Court of learned Additional Judicial Commissioner-III cum Special Judge (NDPS), Ranchi. Earlier bail application of this petitioner was rejected on merit and the same is being renewed on the ground that only intermediate quantity of 4.500 Kg. of Ganja was seized from this petitioner and there is no significant progress in the trial. Learned A.P.P. opposed the prayer for bail. It is submitted that the matter involves total seizure of 23.700 Kg. of Ganja out of which 4.5 kg. was seized from this petitioner alone. Charge in this case has been framed on 19.10.2023 and at present, the case is for prosecution evidence. I do not find any change of circumstance for renewal of bail application. Accordingly, the prayer for bail of the petitioner, is hereby, rejected. However, learned trial Court is directed to expedite the trial. (Gautam Kumar Choudhary, J.) Anit
