Neutral Citation No. - 2025:AHC:91258-DB Chief Justice's Court Case :- WRIT - A No. - 7650 of 2025 Petitioner :- Union Of India And 4 Others Respondent :- Ram Narayan Ram And Another Counsel for Petitioner :- Shashi Prakash Singh (A.S.G.I.), Sheetla Prasad Gound Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This petition is directed against order dated 13.11.2024 passed in Original Application ('OA') No. 1327 of 2024 whereby the OA filed by the respondent has been allowed and he has been held entitled to one notional increment and directions have been given to pay the arrears in terms of the directions given by Hon'ble Supreme Court, as noticed in para 8 of the order impugned. 2. Learned counsel for the petitioner attempted to make submissions regarding the entitlement of the respondent to get the notional increment as he had retired prior to the judgment of Hon'ble Supreme Court. 3. Submissions made, apparently, have no substance. The judgment of Hon'ble Supreme Court in the case of Director (Admin. and HR) KPTCL and others Vs. C.P. Mundinamani and others : (2023) SCC Online SC 401, are very clear and specific making all those who have retired on 30th of June/31st of December entitled to a notional increment, wherever the increments are being granted on 1st of June/ 1st of January. However, the dispute thereafter pertained to the entitlement to arrears, which aspect now has been settled by Hon'ble Supreme Court by passing order in Misc. Application Diary No. 2400 of 2024 in SLP (C) No. 4722 of 2021, according to which only the Tribunal has passed the order. 4. In view thereof, no case for interference is made out in the petition, the same is, therefore, dismissed.
