HAVERI. 581115. - RESPONDENT (BY SHRI NAVEEN CHATRAD, ADVOCATE) THIS MISCELLANEOUS FIRST APPEAL IS FILED UNDER SECTION 173(1) OF MOTOR VEHICLES ACT, 1988 AGAINST THE AGAINST THE JUDGMENT AND AWARD DATED 09.09.2021 PASSED IN MVC NO.1478/2019 ON THE FILE OF THE I ADDITIONAL SENIOR CIVIL JUDGE AND ADDITIONAL MOTOR ACCIDENT CLAIMS TRIBUNAL, RANEBENNUR, AWARDING COMPENSATION OF Rs.6,48,950/- WITH INTEREST AT 9 PERCENT P.A. FROM THE DATE OF PETITION TILL ITS REALIZATION & ETC. 2 THIS MFA COMING ON FOR CONCILIATION BEFORE LOK ADALAT AFTER BEING REFFERED BY THE COURT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER Learned counsel for claimant and representative of appellant-Corporation along with its counsel are present. 2. After prolonged negotiations, matter is settled. Claimant has agreed to receive and the appellant- Corporation has agreed to pay a global compensation of Rs.6,75,000/-(Rupees Six Lakh Seventy Five Thousand only) instead of Rs.6,68,950/- (Rupees Six Lakh Sixty Eight Thousand Nine Hundred Fifty only) awarded by the Tribunal, in full and final settlement of the claim. A joint Memo is filed on behalf of the parties to this effect. Same is accepted. 3. Appellant-Corporation has agreed to deposit the said amount before Tribunal within four months from the date of preparation of Award, failing which the said amount shall carry interest at the rate of 9% p.a. from the date of default, till the date of deposit. The excess amount deposited to be refunded to the appellant-Corporation. 3 4. The apportionment with regard to release and deposit of the compensation amount shall be as per the order of the Tribunal. 5. Miscellaneous First Appeal stands disposed of in terms of Joint Memo. Award of Tribunal shall stand modified accordingly. Draw up the award accordingly. The amount in deposit, if any, shall be transmitted to the concerned Tribunal, forthwith.
