1. The instant petition has been filed under Section 483 of BNSS, 2023 (corresponding Section 439 of Cr.P.C.), for grant of regular bail to the petitioner – Vicky Singh, who has been booked for having committed the offence punishable under Sections 126(2), 115(2), 109, 324(4), 351(2), 191(3), 190 & 238 of BNS, 2023 [S. 238 of BNS, 2023 added later on, and Sections 25 & 27 of Arms Act, 1959, deleted later on], in FIR No. 19, dated 01.04.2025, registered at Police Station Dharamgarh, District Sangrur.

Prime contention of learned counsel for the petitioner is that not a single injury has been caused to the injured – Balwinder Singh, on any vital part of his body, and out of a total of five accused, four have already been granted bail. It is submitted that petitioner is inside the jail for a period of last more than 11 months.

CRM-M-36056-2025 - 2 - complainant submits that on account of the conduct of one of the co- accused, who has already been granted bail and is not appearing before the learned Magistrate, the proceedings regarding committal of the case to the Court of Sessions are getting delayed. Therefore, it is argued that the petitioner, who is seeking to take advantage of the delay caused due to the conduct of his own co-accused, does not deserve the concession of bail.
4. The position before the learned trial Court, as explained by
learned counsel for the complainant, could not be controverted by learned counsel for the petitioner.
5. In view of the above, present petition is disposed of with a direction that the petitioner shall be at liberty to move a fresh bail petition before this Court once all the co-accused, who have been granted bail, start appearing before the learned trial Court. Pending misc. application(s), if any, also stand disposed of.
