The petitioner apprehends his arrest in connection with Complaint Case No. 855 of 2024 registered for the offence under Sections 88, 89, 115(2), 74, 64, 61(2), 3(5) of the BNS but cognizance has been taken under Sections 74, 115(2) and 126 of the BNS. 3. As per the prosecution case, the petitioner is alleged to have established physical relationship with the opposite party no. 02 on the pretext of marriage. 4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. Patna High Court CR. MISC. From the reading of the Complaint, it appears that both the parties were in relationship and when the relationship turned sour, this case has been filed against the petitioner. 6. Considering the aforesaid facts, this application is allowed. 7. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Complaint Case No. 855 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.
