Perused the material available on record and also gone through the impugned order. 2. This bail application has been filed to release the petitioner on regular bail in connection with Hariharganj P.S. Case No.35 of 2018, corresponding to G.R. Case No.932 of 2018 and S.T. No.394 of 2023, pending in the Court of Additional Sessions Judge-II, Palamau at Daltonganj, for offences under Sections 452, 341, 342, 323, 324, 326, 307 and 302/34 of the Indian Penal Code. 3. The allegation against the petitioner is that while trying to commit dacoity, he has assaulted the family members of the informant resulting in death. 4. Learned A.P.P. representing the State submits that the petitioner was an absconder and only surrendered in the year 2023 and thus the trial has been split. 5. Considering the fact that the petitioner was an absconder and out of total eight witnesses, only three witnesses have been examined and the trial is in progress, I am not inclined to release the petitioner on bail. 2 6. Accordingly, this bail application is dismissed. 7. The Trial Court should take all endeavour so that the trial can be concluded preferably within a period of six months. (ANANDA SEN, J.) Prashant.
