(ORAL) Against the order dated 23.06.2022 passed by the authority under The Payment of Wages Act, 1936, the pe""oner herein had filed an appeal before the District Court. The appeal was filed in 2022. An applica"on was moved by the pe""oner for exemp"on/waiver for cer"ficate of deposit amount as ordered by the authority, as per Sec"on 17(1A) of The Payment of Wages Act, 1936. The applica"on was dismissed by way of the impugned order dated 22.07.2025 and simultaneously, the appeal was also dismissed due to non-payment of the necessary amount.

Learned counsel submits that an opportunity has not been granted to the pe""oner to deposit the amount, in case, the applica"on for waiver had been declined.

A:er hearing the conten"ons of learned counsel, the present pe""on is hereby disposed of with the direc"on to the concerned Appellate Authority/Addi"onal District Judge to restore the appeal of the pe""oner and provide an opportunity to make compliance of Sec"on 17(1A) of The Payment of Wages Act, 1936 and then to proceed further to dispose of the appeal in accordance with law.
