1. By virtue of the present bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the applicant seeks grant of regular bail in FIR No.320/2024 dated 27.05.2024 registered at PS.: Govind Puri under Sections 498A/304B/34 of the Indian Penal Code,
1860. 2. Briefly put, it is the case of the prosecution that pursuant to a PCR call made by mother of the deceased (complainant) on 26.05.2024, the police after reaching the spot found her daughter (deceased) hanging from the ceiling on a fan. In fact, a suicide note was found on the left hand of This is a digitally signed order. the deceased stating that she was mentally disturbed. 3. Since the deceased and the applicant herein (husband) solemnised their marriage in December 2017 and the death of the deceased happened within seven years of the marriage, proceedings under Section 176 of the Code of Criminal Procedure, 1973 were initiated and accordingly the present FIR was registered. 4. During investigation, the Medical Report evinced that the cause of death was ‘Asphyxia due to antemortem hanging’ as also there were ‘two- eight injuries’ caused due to blunt force being antemortem in nature as well. It was further revealed that the deceased had filed a complaint earlier on 08.04.2022 before the CAW Cell as well, wherein she had made specific allegations of mental and physical harassment as also dowry against the applicant husband and her in-laws, though the same was later withdrawn by her. Lastly, the complainant also disclosed that some days earlier to the incident, the applicant had also beaten the deceased. 5. Charges have already been framed before the learned Trial Court and the prosecution evidence is being led therein. 6.
In this factual backdrop, this Court has heard learned senior counsel for the applicant and learned counsel for the complainant and learned APP as also perused the materials on record. 7. As borne out, although as per the FSL Report the suicide note does not name anybody, however, at this point of time it is sufficient that it was written by the deceased herself. Moreover, it is also an admitted fact that there are as many as ‘eight bruises’ on the body parts of the deceased being antemortem in nature and her cause of death is due to ‘antemortem hanging’. 8. Further, the deceased had earlier also filed a complaint on 08.04.2022 making specific allegations of mental and physical harassment as also dowry against the applicant and her in-laws, though the same was later withdrawn by her. It is also relevant that the complainant also disclosed that some days earlier to the incident, the applicant had also beaten the deceased. 9. Also, as on date only one out of the twenty two witnesses have been examined as of yet, meaning thereby that the material witnesses are yet to be examined. 10. Cumulatively weighing all the above, as also since the applicant is involved in a serious/ heinous offence, with a bleak past thereto, this Court is not inclined to grant a regular bail to the applicant. 11. Thus, the present application seeking regular bail is hereby dismissed. 12. Needless to say, expression of view(s) on the merits, if any, are solely for the purposes of adjudication of the present application and shall have no bearing on the overall case/ trial involved.
