1. Heard Ms. Afshan Shafaut, learned counsel for petitioner and Sri Vineet Sankalp, Advocate for Respondents-2 and 3.
2. Petitioner has approached this Court claiming compassionate appointment on ground that his mother died in harness on
31.03.2018.
3. Learned counsel for petitioner submits that petitioner has approached earlier before concerned respondent, however, his application for compassionate appointment was not considered.
4. I have perused the record and appears that no proper application is submitted by petitioner. Still considering that it is a case of compassionate appointment, therefore, an opportunity is granted to petitioner to file an application in proper format for compassionate appointment and in case it is filed within four weeks from today, the same will be considered in accordance with law by concerned respondent taking note of judgment passed by Supreme Court in Bank of Baroda and others vs. Baljit Singh, 2023 SCC OnLine SC 745 and Malaya Nanda Sethy v/s State of Orissa and Ors., 2022 SCC OnLine SC 684.
5. It is made clear that this Court has not entered into merit of claim of petitioner regarding compassionate appointment, therefore, issue of delay may also be taken note of.
6. With aforesaid observations, this writ petition is disposed of. Order Date :- 3.7.2025 AK Digitally signed by :- AWADESH KUMAR High Court of Judicature at Allahabad
