State has sought cancellation of bail of the respondent (accused) granted in Case Crime No.01 of 2020 under Sections 420, 465, 467, 468, 471, 201, 120-B IPC Police Station Vigilance Sector District Dehradun on 28.10.2022 by the court of IIIrd Additional Session Judge, Dehradun (In-charge, Special Judge, Vigilance). 4. Heard learned counsel for the parties and perused the record. 5. As soon as, the matter is taken up, the Court asked learned State Counsel, as to whether, similarly placed accused been already granted bail by this Court? The answer is in affirmative. 6. Learned State Counsel would submit that bail cancellation application had earlier been filed, but thereafter, similarly placed co-accused have already been granted bail by this Court and by the Hon’ble Supreme Court. 7. Since similarly placed accused have already been granted bail by this Court and by the Hon’ble Supreme Court, this Court does not see any reason to cancel the bail, granted to the applicant. 8. Having considered, this Court is of the view that the bail cancellation application deserves to be dismissed. 9. The bail cancellation application is dismissed.
