Neutral Citation No. - 2025:AHC:90938 Court No. - 7 Case :- WRIT - C No. - 17411 of 2025 Petitioner :- United Followship For Christian Respondent :- State Of Up And 2 Others Counsel for Petitioner :- Arun Kumar,Arvind Srivastava Counsel for Respondent :- C.S.C. Hon'ble Jayant Banerji,J.
1. Heard learned counsel for the petitioner.
2. This petition has been filed seeking the following relief:-
"(1) Issue a writ order or direction in the nature of certiorari quashing the
order dated 04.02.2025 and 08.05.2025 passed by respondent no.1 in appeal No.1 of 2024: International Service Fellowship For Christian Services Versus Harendra Kumar Masih and others."
3. Shri Arvind Srivastava, learned counsel for the petitioner has state that the order under challenge has been passed on a review application filed by the petitioner challenging an order dated 4.2.2025 whereby an application filed by the respondent no.3 under Section 14 of the Limitation Act, 1963 has been allowed.
4. It is the contention that in the review application, specific grounds regarding the locus of the authorised representative of the respondent no.3 was raised which has been rejected on merits by the order under review.
5. Clearly, the Societies Registration Act does not confer any power on the Commissioner to review its decision. Such being the case, any right of review available to a party would be only procedural review and not substantive review. The review sought by the petitioner involved the consideration of locus standi of the authorised representative of the respondent no.3, which is a review
seeking substantive review.
6. In view of the aforesaid, the rejection of the review application by the authority calls for no interference. Suffice it to say that any observation made in the said order dismissing the review application touching on the merits of the case would not be binding on the parties to the appeal.
7. Subject to the aforesaid observation, this petition is dismissed.
