1. This hearing has been done through hybrid mode. 2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’) seeking quashing of FIR No.453/2021 registered at Police station - Rajouri Garden, District West, Delhi under Sections 147, 354, 427, 323, 506 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as ‘IPC’) and the proceedings emanating therefrom. 3. Issue notice. The learned APP for the State accepts notice on behalf of the State. This is a digitally signed order. 4. The petitioners and respondents no. 2 and 3 are present before this Court and have been duly identified by their counsel and Investigating Officer (IO). 5. Briefly stated, the FIR was registered on 03.06.2021 on the complaint of respondent no. 2 in relation to an incident alleged to have taken place on
02.06.2021. It was alleged that the petitioners had assaulted respondent nos. 2 and 3, damaged their property, misbehaved with respondent no. 2, snatched the mobile phone of respondent no. 3 and extended threats to them. During investigation, Section 356 of IPC was added and a charge-sheet was filed against the petitioners. The proceedings are pending as Criminal Case No.10677/2021 before the learned JMFC, West District, Tis Hazari Courts, Delhi. 6. A cross-FIR bearing No.454/2021 was also registered at the same police station under Sections 354, 354B, 323 and 34 of IPC in relation to the same incident. The petition seeking quashing of the said cross-FIR is registered as CRL.M.C. 1646/2025. 7.
The parties had earlier entered into a settlement dated 21.12.2021 and CRL.M.C. 599/2022 was filed seeking quashing of the present FIR. The said petition was dismissed for non-prosecution on 25.04.2022. Thereafter, the parties entered into a fresh Settlement Deed dated 22.02.2025 and agreed to resolve their disputes amicably. 8. The statements of petitioner nos. 2 to 10 and respondent nos. 2 and 3 were recorded before the learned Joint Registrar on 07.03.2025. Petitioner no.1 subsequently appeared on 22.05.2025 and confirmed the settlement. Respondent nos. 2 and 3 stated that they did not wish to pursue the FIR and had no objection to its quashing. On a query put by this Court, respondent Nos.2 and 3, who have been duly identified by the Investigating Officer, state that they entered into the Settlement Deed dated 22.02.2025 of their own free will and without any pressure, coercion, undue influence or threat. They further state that they have no objection if the aforesaid FIR is quashed. 10. In view of the above, since the parties have amicably resolved their disputes of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings emanating therefrom are liable to be quashed. 11.
Accordingly, FIR No. 453/2021, registered at Police Station Rajouri Garden, Delhi, for the offences punishable under Sections 147, 354, 427, 323, 506 and 34 of the IPC along with all consequential proceedings emanating therefrom, is hereby quashed. 12. Therefore, the present petition is disposed of. Pending application(s), if any, also stand(s) disposed of. 13.
