Neutral Citation No. - 2025:AHC:89867 Court No. - 81 Case :- MATTERS UNDER ARTICLE 227 No. - 5511 of 2025 Petitioner :- Smt Parvati Pandey Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ashutosh Tripathi,Saurabh Anand Mishra Counsel for Respondent :- G.A. Hon'ble Ms. Nand Prabha Shukla,J. Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record. By means of the present petition under Article 227 of the Constitution of India, the petitioner has prayed to set aside the impugned Order dated 17.02.2025 passed by the Additional Sessions Judge, Special Judge POCSO Act, Court No. 3, Prayagraj whereby the Review Application being Misc. Case No. 443 of 2024 (Parvati Pandey Vs. State and others) has been rejected and the impugned order dated 16.02.2024 passed by the Additional Sessions Judge/Special Judge POCSO Act, Court No. 3, Prayagraj rejecting the Criminal Revision No. 587 of 2023 (Smt. Parvati Pandey Vs. State of U.P. and others) and impugned order dated 02.01.2023 passed on Misc. Application No. 264/XII of 2022 (Parvati Pandey Vs. Sankatha Pandey and others) whereby the application under Section 156(3) Cr.P.C. has been rejected. It has been submitted by learned counsel for the petitioner that an application was moved by the petitioner under Section 156(3) Cr.P.C. regarding an incident dated 10.05.2022, but no FIR has been lodged rather an FIR No. 0219 of 2022, under Sections 506, 427 IPC, Police Station-Manda, District-Prayagraj has been registered for an incident which took place on 12.05.2022. Even the revision filed by the petitioner has also been rejected. Upon hearing learned counsel for the parties and from the perusal of records, it transpires that both the disputes pertain to the same cause of action and between the same parties regarding which an FIR is already existing and the charge sheet has been submitted. There is no illegality in the order impugned, therefore, no interference is required. Hence, the petition is dismissed.
