This writ petition has been filed with the following prayer:- "1. issue a writ, order or direction in the nature of mandamus, commanding/directing the authority concerned to implement the order dated 13-10-2023 passed by the Sub Divisional Magistrate, Tehsil Ghosi, District Mau in Case No. 3794 of 2022, Computerized Case No. T202215510203794 Akhilesh Vs. Sanjay and others, under section 116 of U.P. Revenue Code, 2006, within stipulated period as fixed by this Hon'ble Court." The writ petition has been filed seeking a direction for implementation of the partition decree passed in proceedings under Section 116 of the U.P. Revenue Code, 2006. Petitioner's counsel fairly concedes that a restoration application has been filed by one of the co-sharers which is pending consideration. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon authority concerned to decide the restoration application pending in proceedings under Section116 of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
