Neutral Citation No. - 2025:AHC:103787 Court No. - 34 Case :- WRIT - C No. - 17503 of 2025 Petitioner :- Laloo Prasad Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Vinod Kumar Yadav Counsel for Respondent :- C.S.C.,Rahul Sahai,Rameshwar Prasad Shukla Hon'ble Rohit Ranjan Agarwal,J. 1. In the year 1991 the land was allotted to respondent No.5. An application under Section 198(4) of U.P.Z.A. & L.R. Act was moved by the petitioner for cancelling the allotment made in favour of respondent No.5 which was initially dismissed. Against dismissal of the application under Section198(4) of U.P.Z.A. & L.R. Act, the petitioner had moved a revision which was allowed and the matter was remanded to the Sub Divisional Officer. After post-remand, the application was rejected and thereafter the petitioner had preferred revision which has also been rejected. 2. Learned counsel for the petitioner submits that he is having only 15 biswa land and he should have been allotted the land and the land ought not to be allotted to respondent No.5. He further submits that the allotment has been made near his plot. 3. Sri Rahul Sahai, learned counsel appearing for respondent No.5 submits that the allotment was made in the year 1991 and proceedings for cancellation has been initiated in the year 2007 i.e. after more than 17 years, which is barred by Section 198(5) & (6) of U.P.Z.A. & L.R. Act. 4. I have heard learned counsel for the parties and perused the material on record. 5. I find that the application moved for cancellation of allotment under Section 198(4) of U.P. Z.A. & L.R. Act has been filed at a belated stage and hit by the provision of Section 198(5) &(6) of the U.P. Z.A. & L.R. Act, hence no case for interference is made out. 6. The writ petition fails and is hereby dismissed. Order Date :- 3.7.2025 Kushal Digitally signed by :- KUSHAL AGRAWAL High Court of Judicature at Allahabad
