The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri P NAGENDRA REDDY, Advocate for the Petitioner and of PUBLIC PROSECUTOR for the Respondent and the Court made the following; THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY £RIMINAL PETITION NO.1259 OF 20Z± ORDER:- This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail, in crime No.226 of 2024 of Kavali Rural Police Station, Sri Potti Sriramulu NeIIore District. 2. A case has been registered againstthe petitioner herein and another for the offence punishable under section 20(b)(ii)(B) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short tthe NDPS Act'). 3. Case of the prosecution, in brief, is that, on 20.12.2024, on credible information, the Inspector of Police, along with his staff and mediators, rushed to Musunuru Toll Plaza, Kavali Mandal and found the accused in possession of 10.045 KGs of Ganja. The contraband, along with other material, was seized under cover of a mediators report. 4. Heard. Perused the record. k_iE 5. The petitioner is in judicial custody since 21.12.2024. The quantity of Ganja allegedly seized from the possession of the accused is 10.045 Kgs, which is not a commercial quantity. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/Al on the following conditions. i) The petitioner/Al shall be released on bail on his executing personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satl'sfaction of the learned Additional Judicial Magistrate of First Class, Kavali, SPSR Nellore District. ii) On release, the petitioner shall appear before the station House Officer concerned, once in a week i.e. on every sunday between 10.00 am and 01.00 pm, till filing of the charge sheet. iii) Petitioner herein/Al shall not go beyond the jurisdiction of Sri Potti Sriramulu Nellore district, Andhra Pradesh State, wl-thout leave of the trial Court and he shall make available his location through mobile phone by pairing it with the mobile phone of the Investigating Officer round the clock. 6.
