Neutral Citation No. - 2025:AHC:90920 Court No. - 5 Case :- WRIT - A No. - 7623 of 2025 Petitioner :- Smt. Kanti Devi Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Kanhaiya Lal Counsel for Respondent :- Anand Kumar Srivastava,C.S.C. Hon'ble Ajay Bhanot,J. The petitioner superannuated from service on 31.10.2010. He claims that he is entitled to the benefit of Assured Career Progression (A.C.P.) and bonus. He has made a representation in this regard but to no avail. The only prayer made by Shri Kanhaiya Lal, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Harshit Pandey, learned counsel for the respondent No.3 submits that the matter requires determination of
facts by the competent authority in light of applicable provisions of law in the first instance. However, he fairly contends that service benefit/claim is liable to be decided by the competent authority in a reasonable time frame. In wake of the aforesaid submissions and without going into the merits of the case, the respondent no.3 is directed to decide the representation of the petitioner regarding
grant of certain entitlements including the benefit of Assured Career Progression (A.C.P.) and bonus in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. The petitioner superannuated from service on 31.10.2010 and approached this Court in May, 2025. In view of the admitted delay on the part of the petitioner without any good cause in approaching the Court no interest shall be admissible for the aforesaid period. The writ petition is finally disposed of.
