The writ petition has been filed for the following reliefs :- (i) directing to respondent No.3, i.e. Director Primary Education, Bihar, Patna, to give the Trained pay scale to the Petitioners from the date of their respective appointment, in the light of memo No.1790 dated 16.10.2024 as the petitioners claim is at par with the Petitioner of C.W.J.C. No.- 9416/2019. (ii) For further be pleased to issue writ in nature of Mandamus directing to the respondents No.-3 to make the payment of arrear of Salary calculated on the basis of the trained pay Scale of the Petitioners. (iii) For further be pleased to issue any other appropriate writ/Writs, order/orders, Direction/Directions or command/Commands to respondents concern. 3. Learned counsel for the petitioners submits that all these petitioners had completed their training of B.Ed. from respective training colleges and thereafter, they have been appointed as trained elementary teachers and after joining in their respective schools, they have also completed Bridge Courses of six months and their results have also been published

In this regard, the learned counsel for the petitioner has taken this Court to Annexure-P/4 whereby the similarly situated person, Satyendra Kumar Ojha had filed the writ petition and thereafter, had submitted representation and over such representation, the Director Primary Education has come out with a decision which is contained in Memo No.1790 dated 16.10.2024 whereby the writ petitioner in C.W.J.C. No.9416 of 2019 has been allowed the trained pay sacle from the date of appointment and these petitioners also contend that their case is also similar to that of Satyendra Kumar Ojha. 4.

It has next been submitted that learned counsel for the petitioners have also filed the representations but from the representation, it does not appear that the details, which is actually required for adjudication is referred/mentioned. Therefore, at this stage, learned counsel for the petitioner submits that all these petitioners would be filing a detailed representation indicating all such inputs, which are actually required for consideration in grant of trained pay scale before Director Primary Education within a period of two weeks and on submission of such representation, the Director Primary Education would be obliged to take into account all such inputs and the eligibility, as required in terms of the policy framed by
Patna High Court CWJC No.13633 of 2025(2) dt.29-08-2025 6/6 the Government in this regard and necessary orders would be passed by concerned respondents/authorities within a period of six weeks from the date of such order and on grant of such benefits, the same shall be extended within further period of two weeks thereafter. 5. Learned counsel for the State submits that the petitioners should be directed to file individual representation giving details of their eligibility which shall be considered by the Director Primary Education.
