A case has been registered against the petitioner herein and others for the offences punishable under Sections 118(1), 109 & 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the prosecution, in brief, is that on 29.01.2025 at 10.00 a.m., due to previous ill-feelings, while the de facto complainant was returning from Pulivendula on his motorcycle, A.1 and A.2 came at JNTU College with iron rods and chased him with a view to kill him and beat him on his hands. Having afraid of the same, the de facto complainant sped away on his motorcycle and when he reached Thonduru Petrol bunk, A.3 & A.4 had parked their vehicles on the road, causing him to collide with their vehicles and fall. Then, A.1, A.2 & A.4 attacked him with sticks and shouted that he was the person who stopped the drought bills. Then, all the accused beat him on his head and attempted to kill him, due to which the de facto complainant sustained severe bleeding injuries on the right side of forehead and swelling injuries on left shoulder, elbow, right leg knee, right hand palm and little finger. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that specific accusations have been made as against the petitioner herein and other accused. Learned counsel appearing for the petitioner/A.3 submits that the 3 followers of the de facto complainant attacked the petitioner herein/A.3 on 03.01.2025 and in that connection the petitioner herein gave a report to the police. Pursuant to which, a case in Crime No.1 of 2025 of the same police station was registered. But, a perusal of the said report goes to show that no accusation was made against the de facto complainant and even there is no mention that the accused therein are the followers of the de facto complainant. Learned counsel for the petitioner further submits that on the date of the incident, the petitioner herein/A.3 was not at the scene of offence but was in Pulivendula and due to political rivalry, he has been implicated in the present crime. The truth or otherwise of the said plea of alibi has to be determined during the course of trial, but not at this stage. 6. Learned Assistant Public Prosecutor submits that investigation is not yet completed and some more witnesses are to be examined. He further submits that if the petitioner is released on bail, he may hamper the investigation and tamper with the material evidence. 7. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner herein/A.3, at this stage. 8.
