Upon coming of this matter for consideration, in the first instance, petitioner 1 was examined by the Court in order to ascertain the veracity of
facts pleaded in the petition, as well as the marriage claimed to have been solemnized by petitioner 1 with petitioner 2. The petitioner 1, however, upon asking of the Court about the solemnization of marriage, gave contradictory and conflicting details about the solemnization of the marriage. Initially, she stated that the Nikah ceremony was performed by her in person with petitioner 2 yet, subsequently, would submit that she was represented in the Nikah ceremony by a Wakeel, whose name, when asked by the Court, was not correctly revealed. The petitioner 2, upon being asked about the solemnization of marriage by him with petitioner 1, too gave conflicting and contradictory versions about the solemnization of marriage. Under these circumstances, this Court is not convinced about the factum of the marriage/Nikah claimed to have been entered into by the petitioners and is, therefore, not inclined to pass any interim order thereof, including the order of protection sought in the petition. Accordingly, the petition stands dismissed.
