By the present writ petition, the petitioner is seeking a direction towards the respondent/State to make payment of compensation by acquisition of the land bearing khasra No. 345 admeasuring 0.13 hectare situated at Village Bhanoura, Tahsil- Ballarpur, District- Balrampur-Ramanujganj (C.G.). As the land of the petitioner has been utilized by the Nagar Panchayat Balrampur for construction of Gaurav Path. 2. Learned counsel for the petitioner would submit that the petitioner is the registered land owner of land bearing khasra No. 345 admeasuring 0.13 hectare situated at Village Bhanoura, Tahsil- Ballarpur, District- Balrampur-Ramanujganj (C.G.). The land of the petitioner is being used by the Nagar Panchayat Balrampur/respondent no. 5 for construction of Gaurav Path without 3 acquisition of the said land and no compensation is being paid to the petitioner. 3. Learned counsel for the state would submit that the Collector Balrampur will verify and examine the fact narrated by the petitioner by making a spot inspection to the land of the petitioner and necessary steps will be taken in accordance with law for acquisition of land, in case, it is found that the land of the petitioner has been used for construction of the road i.e. Gaurav Path. 4. I have heard counsels for the parties and perused the pleadings and document placed by the petitioner. 5. From perusal of document, particularly (Annexure P/1) which is a B- 1 Khasra, where, it is mentioned that the petitioner is registered land owner of Khasra No. 345 admeasuring 0.13 hectare of Village Bhanoura, hence, it is directed that the Collector shall take steps for verification and demarcation of the land in question as narrated by the petitioner within a period of 50 days from today and if, it is found that the petitioner’s land is being used for Gaurav Path, necessary steps be taken for acquisition of land, in accordance with law and the Collector shall ensure payment of compensation to the petitioner. 6.
