Supplementary affidavit filed by learned counsel for the applicant, explaining criminal history of the accused-applicant is taken on record. 2. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 3. The present bail application, seeking bail, has been moved by the applicant-accused-Shiv Gopal @ Raja involved in Case Crime No.39 of 2023, under Section 2/3 U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 Police Station Radha Nagar, District Fatehpur. 4. Learned counsel for the accused-applicant contends that in gang-chart three base cases have been shown against the accused- applicant in which he is on bail. Criminal history of 9 other cases has been explained in affidavit filed in support of the bail application. In all the cases the applicant is enlarged on bail. The applicant is in jail since 21.02.2023. As such, he prays that the accused/applicant be enlarged on bail. 5. Learned A.G.A. has opposed the prayer for bail and submitted that including present gangster case there is criminal history. There is no conviction against the applicant in any case. 6. This Court has taken into consideration the rival submissions made by the parties and perused the records, which prima facie reveals that the criminal history is explained in the bail application and supplementary affidavit, wherein, he is on bail. There is no conviction against the applicant in any case. The applicant is in jail since 21.02.2023. 7. Hence, without touching the merit of the case, the bail application is allowed. 8. Let accused/applicant-Shiv Gopal @ Raja be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
