1. Heard Sri A.K. Maurya, learned counsel for petitioner and Sri A.B. Sinha, learned Standing Counsel.
2. Petitioner is a retired employee in the office of Assistant Registrar (Cooperative), Ballia who has retired on 31.12.2019. Undisputedly, he is entitled for pension and his pension was fixed also. However, it was not regularly paid, therefore, he approached this Court by way of filing Writ A No. 21489/2023 which was disposed of with a direction to pay pension and other benefits to petitioner. Since arrears of pension were not paid as well as pension was not regularly paid, therefore, due to this reason, petitioner has approached again this Court by way of present petition.
3. Learned Standing Counsel has not denied that petitioner is not getting pension regularly, however, he submits that there are certain financial problems in the Department and due to this, not only petitioner but other retired employees are not getting pension regularly.
4. Learned counsel for petitioner has not able to dispute aforesaid submissions of learned Standing Counsel.
5. I have considered above submissions and I am of the opinion that only on a ground of financial problem, pension cannot be stopped completely, therefore, this
writ petition is disposed of with an observation that respondents will take endeavour to clear the arrears of pension and will pay regular pension on monthly basis and in case there is a financial problem, the respondents will inform about the same to petitioner.
