W.P.No.20287 of 2025 O R D E R The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondent to return the amount of Rs.69,600/- recovered towards unimplemented punishment with 10% interest to the petitioner.
2. The learned counsel for the petitioner would submit that the petitioner joined in the Respondent-Corporation as Conductor and after rendering 33 years of service, he retired from service during 2023. The
learned counsel would further submit that at the time of retirement, the respondent had illegally deducted a sum of Rs.69,600/- from his terminal benefits towards unimplemented punishment, which is contrary to the
judgment of this Court. Hence, he has sent a representation on 07.03.2025 and such representation is pending with the respondent.
3. However, the learned Standing Counsel for the respondent would object the contentions raised by the petitioner. However, the learned Standing Counsel would fairly submit that if any representation had been 2/4 https://www.mhc.tn.gov.in/judis
W.P.No.20287 of 2025 sent by the petitioner, the same will be considered by the respondent, within a reasonable time.
4. In such view of the matter, this Court deems it appropriate to direct the respondent to consider the petitioner's representation dated 07.03.2025 and pass orders on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.
5. With the above direction, the Writ Petition is disposed of. No costs.
