Per contra, learned AGA opposed the prayer for bail but could not dispute the arguments on facts advanced by learned counsel for the applicant. 8. I have heard learned counsel for the parties and perused the record of the case. 9. From perusal of FIR of the present case, it reflects that as per allegation co-accused Abhishek Patel, husband of the deceased committed the murder of his wife alongwith his brother and bhabhi but it reflects that during investigation, applicant who is cousin of principal accused Abhishek Patel i.e. husband of the deceased has been made accused on the basis of his statement and it reflects, except the statement of the co-accused and confessional statement of the applicant before police, there is no cogent and admissible evidence against him. 10.
10. Further, there is no evidence that applicant resided in the same house where deceased resided alongwith her husband and his family members. 11. Further, applicant is having no criminal history and he is in jail in the present matter since 17.10.2024 i.e. for last more than six months. 12. Therefore, considering the facts and circumstances of the case, discussed above, in my view, applicant is entitled to be released on bail. 13. Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed. 14. Let the applicant-Amit Patel, be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall appear before the trial court on the dates fixed, unless his personal presence is exempted.
