As per prosecution story, the applicant is stated to have enticed away the minor daughter of the informant on 6.12.2024 at about 9.00 am. 6. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by more than two days and there is no explanation of the said delay caused. 7. It is further stated that the victim is the consenting party, as is evident from the fact that she has stated in her statement recorded u/s 183 B.N.S.S. that she talked to the applicant at a temple and she was forcibly taken in an ECO van by the applicant to a room. She did not raise any alarm during the said travel in the ECO van. The victim has stayed in the said room for four days, although she has stated that she was raped by the applicant but the said allegations are false on the ground that when she was asked of the meaning of 'rape' by the Magistrate concerned, she kept silent. 8. It is further argued that the victim is 17 years old as per ossification test report, as such, a leverage of two years may be granted to the applicant on the upper side. 9. Learned A.G.A. has vehemently opposed the bail application but has not disputed the aforesaid submissions of learned counsel for the applicant.
11. Considering the facts and circumstances of the case,
submissions made by learned counsel for the parties, the evidence on record, the fact that the victim is the consenting party and the delay in institution of FIR, without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
12. Let the applicant- Ajay, who is involved in aforementioned case crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions. If in the opinion of the Trial Court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the Trial Court to treat such default as abuse of liberty of bail and proceed against him in accordance with law.
13. In case of breach of any of the above conditions, it shall be a ground for cancellation of bail.
14. It is made clear that observations made in granting bail to the applicant shall not in any way affect the learned trial Judge in forming his independent opinion based on the testimony of the witnesses.
