Status report has been filed, which is taken on record. Heard. The petitioner has filed the present petition for seeking permission to travel to Malaysia from 03.02.2025 till 10.02.2025 to explore the educational avenues for post graduation in the medical field for his daughter. It has been stated that the petitioner intends to visit appropriate institution in Malaysia to get detailed information regarding admission,procedures, curriculum & facilities available in the medical discipline.The petitioner would abide by the terms and conditions which the Court may impose. Hence the present petition. The petition is opposed by filing a detailed status report asserting that the petitioner had earlier visited United Kingdom w.e.f 10.09.2024 till
16.09.2024. The petitioner has not disclosed the information and in case petitioner discloses the
information, the police has no objection for allowing the application. The status report itself shows that the petitioner had earlier visited United Kingdom w.e.f 10.09.2024 till 16.09.2024. It has not been mentioned that the petitioner had violated any condition during such visit. This shows that the petitioner is likely to return to India and there is no apprehension that he would abscond. The police asserted that the petitioner is not co-operating with the investigation. The remedy of the police in such a situation is to move an application for the cancellation of the bail. The police cannot put the petitioner to terms that he can go abroad only if he supplies the information to them. The only consideration at this stage is whether the petitioner is likely to return to India after visiting abroad or not. The previous conduct of the petitioner shows that he is likely to return to India. The Police has also not expressed any apprehension that the petitioner would not return to India, therefore, the present application is allowed and the petitioner is permitted to go to Malaysia to w.e.f 03.02.2025 to 10.02.2025, subject to furnishing of personal and surety bond in the sum of Rs.1,00,000/-each to the satisfaction of learned Trial
Court/ Additional Registrar(Judicial) of this Court with an undertaking to return to India after completion of his journey on or before 11.02.2025.
The petitioner is also directed to furnish the details with regard to his flight, boarding & lodging to the concerned Police Station within a period of two days from today.
