1. Prayer in this petition, filed under Section 483 of BNSS, seeking regular bail in case FIR No. 60 dated 02.09.2024, under Sections 2(c)/61/85 of NDPS Act, registered at Police Station Sadar Abohar, District Fazilka. 2. On 02.07.2025, following order was passed:
“1. Present petition has been filed by the petitioner, seeking grant of regular bail in case bearing FIR No.60, dated 02.09.2024, under Section(s) 22(c)/61/85 of the NDPS Act, registered at Police Station Abohar, District Fazilka. 2. Counsel for the petitioner submits that, at this stage, petitioner does not wish to press the prayer for regular bail. However, it is submitted that petitioner seeks interim bail on compassionate grounds, as his wife is suffering from a CEMRI brain tumor and is currently undergoing treatment at PGIMER, Chandigarh. 3. As per the medical record dated 04.01.2025 (Annexure P-2), doctors at PGIMER have advised surgical intervention. Thus, petitioner prays for grant of interim bail for a period of two months from the date of his release, to enable him to provide necessary care and support to his ailing wife during this critical period. 4. Notice of motion. 5. On advance notice, Mr. Manjinder Singh Bhullar, DAG, Punjab, puts an appearance on behalf of the respondent/State, and files custody certificate in the Court today and the same is taken on record. Learned State counsel, on instructions from ASI Rajwinder Singh, submits that the surgery of the petitioner’s wife has already been conducted, and the next surgery has been advised after a period of six months. 4. Faced with this situation, learned counsel for the petitioner seeks permission to withdraw the present petition at this stage. 5. In view of the above, the present petition is dismissed as withdrawn at this stage.
