Mr. Sanjay Kumar, Advocate for the applicant. Ms. Manisha Rana Singh, D.A.G. for the State. Applicant Rajveer Singh seeks anticipatory bail in Criminal Case No.91 of 2024, State Vs. Rajveer Singh, under Sections 363, 366 and 120B IPC, pending in the court of Judicial Magistrate/Civil Judge, Tharali, District Chamoli. Heard learned counsel for the parties and perused the record.
Learned counsel for the petitioner would submit that during investigation, the applicant was granted anticipatory bail on 14.05.2024, in ABA No.211 of 2024, Rajveer Singh Vs. State of Uttarakhand, by this Court, but at that time, the offence was under Section 363 IPC only. Now, chargesheet has been submitted for the offences under Sections 120B and 366 IPC also, and on 13.12.2024, cognizance has been taken. He would submit that till date, Non Bailable Warrants have not been issued against the applicant. The applicant has already been granted anticipatory bail in the offence. During investigation, it was offence under Section 363 IPC. Now, some more offences are added. Therefore, the offence under Sections 366 and 120B IPC shall also be covered by this Court’s anticipatory bail
order dated 14.05.2024, passed in ABA No.211 of 2024, Rajveer Singh Vs. State of
Uttarakhand. The anticipatory bail application stands disposed of, accordingly.
