Heard Mr. A. Ali, learned counsel for the petitioners and Mr. R.R. Kaushik, learned Addl. P.P. for the State respondent. This is an application filed by the petitioners namely, (1) Jahidul Islam and (2) Ahidul Islam under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for pre-arrest bail, apprehending arrest in connection with PRC Case No. 443/2024 (arising out of North Lakhimpur P.S. Case No. 142/2023) under Sections 379/ 411 IPC read with Section 11(1) (d) of the Prevention of Cruelty to Animal Act and read with Section 13(1) of the Assam Cattle Preservation Act. The matter relates to illegal transportation of cattle. The learned counsel for the petitioners has submitted that both the petitioners have been shown as absconders in the charge sheet, although the names of the petitioners are not mentioned in the FIR. It is further submitted that the offence alleged against the petitioners are triable by the Magistrate. The petitioners are ready to face the trial. The learned Additional Public Prosecutor, on the other hand, has submitted that the petitioners may approach before the trial court seeking regular bail. Considering the submission of the learned counsel for the parties, both the petitioners namely (1) Jahidul Islam and (2) Ahidul Islam are directed to appear before the trial Court within 15 (fifteen) days from today and in the
Page No.# 3/3 event of their appearance and filing of any such bail application, learned trial court shall release the petitioners on bail on furnishing bond of Rs. 20,000/- each with one surety each of like amount to the satisfaction of the leaned trial Court/ jurisdictional Magistrate. With the above directions, this bail application stands disposed of.
